Hubertus Thum specializes in distribution law, (unfair) competition law, IP/IT law and data protection law and handles litigation as well as arbitration proceedings in these fields.

Based on his many years of experience in distribution law, Hubertus Thum advises and represents national and international clients in the drafting of distribution-related contracts and their termination, including the assertion of or defense against claims for goodwill-indemnification, investment compensation, and damages.

Furthermore, Hubertus Thum supports companies and agencies in all matters of marketing and advertising law (social media, ambush marketing, online and offline, etc.) and assists clients and their marketing agencies in developing legally sound advertising subjects and campaigns. He regularly represents clients in asserting and defending claims under (unfair) competition law and trade mark law before the Austrian courts.

Hubertus Thum is also a certified data protection officer and assists in the preparation of practice-oriented data protection concepts. He represents clients before courts and administrative agencies in cases of data breaches and other data protection proceedings.

Moreover, he is a member of the legal committee of the Austrian Franchise Association and has many years of experience in franchise law. He advises and represents franchisors from the start-up phase of the franchise system to their international expansion via master franchisees or area developers. His expertise in this field is supplemented by his experience in advising and representing franchisees in all matters related to the operation of their business as well as in disputes with franchisors.

Hubertus Thum is an author of numerous publications in the field of franchise law and a lecturer in the field of distribution and data protection law at various organizations, including the Viennese Economic Chamber.

He studied law in Austria (University of Vienna), where he also completed his doctorate, in Switzerland (University of St. Gallen), and in Portugal (Católica Global School of Law Lisbon). He is admitted to the Austrian bar.
