Michael Hofstätter focuses his practice on domestic as well as international dispute resolution with an emphasis on commercial arbitration and litigation matters.

He has represented clients in a number of high-stake commercial litigations and is our clients’ competitive edge in court proceedings ancillary to arbitrations and foreign litigations, including enforcement, setting-aside, challenge of arbitrators, securing of evidence, and provisional security proceedings, such as asset arrests and preliminary enforcement measures. He also frequently acts as co-counsel in foreign litigations involving complex aspects under Austrian law and as legal expert.

In addition, Michael Hofstätter acts as counsel and arbitrator in ad-hoc and institutional arbitration proceedings, including under the rules of ICC, VIAC and LCIA, governed by a number of different substantive and procedural laws. His case experience covers post M&A disputes and other complex matters covering a wide spectrum of commercial and industrial sectors, including energy, industrial engineering, telecommunications, pharma, and medical products and devices.

Based on his rich litigation and arbitration experience, Michael Hofstätter regularly advises and represents clients in drafting and negotiating contracts for commercial and industrial projects and is often retained to provide legal guidance throughout the implementation and performance of these. He has significant experience with EPC and EPCM contracts in general, and the FIDIC Rainbow Suite in particular.

Michael Hofstätter also advises private clients on both civil and administrative aspects of forestry, hunting and weapons law.

He completed his studies at the University of Vienna, Austria, and the Cardozo Law School, Yeshiva University, NY. He is admitted to the bar in Austria and in NY. Michael Hofstätter was also a research fellow for civil procedural law at the University of Vienna School of Law. He is a regular lecturer at the Danube University Krems for domestic and international arbitration law, and a lecturer at the BOKU University Vienna for hunting and forestry law. He is also the author of numerous publications in the field of dispute resolution.
